I was a horse rider\u00a0so I knew all the gullies,&#8221; she says.<\/p>\n<aside class=\"_2X-83 g1U-R _1VIKT\" data-component=\"Pullquote\">\n<blockquote class=\"_2Bzft\">\n<p class=\"_1HzXw\"><em><strong>&#8220;It&#8217;s a tiny little pocket of land, a bush block with beautiful gum trees.&#8221;<\/strong><\/em><\/p>\n<\/blockquote>\n<\/aside>\n<p class=\"_1HzXw\">After the death of the original owner, Ms Higgins&#8217; grandmother, in 1993, the block was forgotten about by the family and left vacant. Ms Higgins moved to northern NSW.<\/p>\n<figure class=\"_2XhY1 _2X-83 g1U-R _3V6uS\" role=\"group\" data-print=\"inline-media\" aria-labelledby=\"100540208\" data-component=\"Figure\" using the land to access its neighbouring construction site, a retirement village.<\/p>\n<p class=\"_1HzXw\">When Ms Higgins made her objections clear,\u00a0the developer commenced legal action in the New South Wales Supreme Court arguing that the land should be transferred into its name.<\/p>\n<h2 class=\"_3HiYf _2K_6X _1cBaI _2b-O4 _2yZBa _3I3Xh _2uBSR _10YQT _1lh6E\" data-component=\"Heading\">Use it or lose it<\/h2>\n<p class=\"_1HzXw\">Squatters&#8217; rights, a &#8216;use it or lose it&#8217; legal doctrine, is still regularly raised in Australian courts.<\/p>\n<p class=\"_1HzXw\">The framework varies from state to state in Australia, but in New South Wales, it takes 12 years before the registered proprietors title is extinguished.<\/p>\n<p class=\"_1HzXw\">During that time, the possessor has to prove that they were not only using the land\u00a0but that they also had exclusive possession of the land.<\/p>\n<p class=\"_1HzXw\">Catherine Barry, a senior solicitor for McCartney Young Lawyers, helped to<strong>\u00a0<\/strong>represent Ms Higgins in the Supreme Court case.<\/p>\n<p class=\"_1HzXw\">According to Ms Barry, the company claimed that they had occupied the land many years ago and were entitled to ownership of the property under &#8216;adverse possession&#8217; or &#8216;squatters&#8217; rights&#8217;.<\/p>\n<figure
