A couple who bought a $1.2 million leaky home will receive a payout from the former owner after a court found she behaved deceptively.
Howard and Lynne Mitchell bought a town house, part of a complex of units in the upmarket Auckland suburb of Remuera, in 2017.
When they discovered it was leaky they filed proceedings against the former owner, the builder who inspected the property before settlement and Barfoot and Thompson in the Auckland High Court.
A decision released this month from Justice Gordon ruled in the couple’s favour, ordering the former owner and building inspector to pay a confidential sum.
