An apartment building’s body corporate manager has been ordered to pay nearly $120,000, plus costs and interest, to a buyer misled about its leak problems.

When Michael Douglas Roberts paid $397,000 in early 2014 for a 140sqm apartment with a carpark the Sirocco Apartments in Wellington already had several leak problems.

But the body corporate manager just said the walkways had been leaking but were fixed, a judge decided. Roberts said he would not have bought the apartment if he had known the true history of weathertightness issues.

Since then things have only got worse. The latest estimate is that the 44-unit, 11 storey complex finished in 1999 will cost $26.1 million to fix.
