Contractors involved in the Transmission Gully roading project in Wellington are pursuing legal action against Waka Kotahi.

Waka Kotahi has confirmed that CPB Contractors and Heb Construction Joint Venture have initiated legal proceedings due to ongoing concerns about project completion.

Brett Gliddon, the general manager of transport services, stated that the road has been open to the public since March last year and has been functioning well in terms of regional resilience and service. However, it remains unfinished as there are specific requirements outlined in the project contract that have not been met.

Gliddon explained, “CPB Contractors and HEB Construction Joint Venture (CPBHEB JV) have filed legal action against Waka Kotahi to address our ongoing expectations that it complies with these contractual obligations.”

The alleged incomplete tasks encompass the creation of a new State Highway 59 connection between Mackays Crossing and Paekākāriki, the development of a recreational track, and the execution of quality assurance tests.

Regarding the ongoing discussions of a commercially sensitive nature that have taken place over the past year, Waka Kotahi has stated its intent to defend itself in court. Gliddon added, “We will safeguard the interests of the Crown and address these legal proceedings, while simultaneously ensuring accountability among the contracting parties.”

Waka Kotahi has stressed the importance of contractor Wellington Gateway Partnership (WGP) and its construction sub-contractor CPBHEB JV fulfilling their contractual obligations. Disagreements exist concerning the outstanding work and the quality standards that must be met to conclude the project as stipulated in the contract.

Waka Kotahi has also clarified that it is collaborating closely with Ventia and the Wellington Gateway Partnership to ensure the highway’s maintenance and safety for road users. Public access to the highway will not be affected, and the planned project works are expected to continue as scheduled.
