A former Sydney real estate agent, Kally Anne Fitzgerald, has been sentenced for a disturbing break-in at a Northern Beaches residence, involving the intrusion into a teenage girl’s bedroom. The judge characterized the incident as “terrifying,” leading to Fitzgerald receiving a two-year jail sentence, which will be served within the community through an intensive correction order. Fitzgerald, 43, pleaded guilty in the Downing Centre District Court.

According to the agreed-upon facts, last August, Fitzgerald entered a North Curl Curl house through the back laundry door after attempting the locked front door. Inside, she proceeded to the bedroom of a 16-year-old girl, who was listening to music and became aware of someone approaching from the hallway.
Upon opening the bedroom door, Fitzgerald was greeted by the girl, to which she responded with a brief apology. Subsequently, Fitzgerald closed the door, walked down the hallway, entered the garage, and eventually left the house, driving away. The parents of the teenager initially doubted the incident until reviewing CCTV footage.
The facts revealed that the girl’s father noticed missing AirPods and reported the break-in to the police. Investigations linked Fitzgerald’s phone location to the property during the time of the incident. Fitzgerald was arrested at her Bilgola Plateau residence on August 28, 2022, where police discovered a pair of AirPods matching the missing ones.

Fitzgerald attempted to swap the AirPods with another pair before they were seized, but she denied the theft. She claimed to be in the area to “chill out” for a few minutes after dropping off a friend nearby. When unable to access a lookout, she started “looking in the house from the outside” due to her previous experience as a real estate agent, describing the house as vacant and expressing curiosity.
Fitzgerald’s questionable actions included providing a sophisticated lie to the police until confronted with CCTV evidence. Judge Gina O’Rourke expressed concern over the “terrifying” nature of a stranger entering the teenager’s home and noted Fitzgerald’s commission of three shoplifting offenses while on bail for the break-in.

Fitzgerald’s troubled history included a dismissal from LJ Hooker Dee Why in 2018 for stealing a tenant’s credit card. She had since engaged in part-time online selling, but legal troubles persisted, with prior sentences for shoplifting and a conviction for negligent driving in 2022.
Her defense highlighted a history of trauma and substance misuse, noting her sobriety since 2019, engagement in drug treatment, and recent psychological counseling. Fitzgerald’s two-year intensive correction order includes a curfew, community service, psychological and drug treatment continuation, and abstinence from alcohol.
